Permit violations lead to three-month review

The City of Milpitas issued an Administrative Citation on October 25, 2010 to the owner of karaoke establishment KTV Musicland for three zoning violations. On December 8, the city's Planning Commissioners also scheduled a public hearing to review the business' conditional use permit in three months.
The conditional use permit for a karaoke venue in the Ulfert's Center, 788 Barber Lane, was originally granted in November 2006 with subsequent periodic reviews. KTV Musicland opens daily from 4 p.m. until 2 a.m. and has a reception area and nine karaoke rooms. No food or alcohol is allowed. Water and tea are sold as refreshments.
On three separate occasions, Milpitas Police Department found evidence of alcohol consumption in KTV Musicland's private rooms. On one such occasion (October 16, 2010), the venue was still open at 3 a.m. Condition 10 of the conditional use permit prohibits consumption of alcoholic beverages within the facility. Condition 12 requires the business to close by 2 a.m. and all customers to have vacated the premises by 2.30 a.m. On October 21, 2010, patrons were cited for underage consumption of alcohol and its distribution to minors. There was no evidence of food sales.
The business owner has settled the $400 Administrative Citation. Staff will return with more details and information in three months.
