Government Finance Officers Association Distinguished Budget Presentation Award for Fiscal Year 2009-10. Mayor Livengood presented the award, which the City of Milpitas has received for the past 10 years, to Finance Director Emma Karlen.

Consent Calendar
Received progress report on Senior Center Project.

Receive financial status report for the six months ended Dec 31, 2009.

Approved FY 2009-10 mid-year budget appropriations for Operating Budget and Capital Improvement Project Budget and approved the change of employee-position title from Public Information Specialist to Video Media Specialist.

Approved mayoral recommendations for appointments of Dan Arbaugh, Bruce Choy and Juan Samano to the Veterans Commission for terms expiring Feb 2013 and requested waiver of the requirement that residents may only serve on one commission at a time. Arbaugh serves on the Sister Cities Commission.

Supported Milpitas Unified School District's (MUSD) parcel tax Measure, as recommended by Vice Mayor McHugh. A tax of $84 per parcel, per annum, for five years (seniors exempt) is proposed. The revenue will enable MUSD to provide core educational services in FY 2010-11. The Measure will appear on the June 2010 ballot. (4 "AYES," 1 "NO." Councilor Giordano supports the school district but does not feel the proposed form of the parcel tax is fair or equitable).

Approved a budget appropriation for Community Development Block Grant-Recovery funds in the amount of $157,293 for program activities.

Introduced an ordinance imposing liability on social hosts who allow or encourage underage abuse of alcohol and underage drinking. It imposes two types of liability - criminal and recovery of City response costs.

Waived second reading and adopted an ordinance (introduced Jan 19) repealing various sections (obsolete, unused or superseded by state law) of the Milpitas Municipal Code. This is proposed to be an annual action to ensure Code is up-to-date.
